Police Report an Off-duty ICE Agent Who Seemed Drunk Was Found Sleeping in the Wrong Yard

Police report an off-duty ICE agent who seemed drunk was found sleeping in the wrong yard in Fresno and attacked the 72-year-old owner and his daughter. The homeowner shot him. The agent now faces felony assault charges.

Here is what the Fresno Police Department has said so far. In the early hours of Friday, October 9, a woman found a man asleep on the front lawn of her family's home. Her 72-year-old father went outside to wake him and get him to leave. Once the man was awake, police say he appeared intoxicated and assaulted the father. The daughter stepped in to help, and police say the man physically attacked her as well.

Police say the father, fearing for his own safety and his daughter's, pulled out a handgun and shot the man. Investigators say the homeowner legally owned the gun.

New: the agent has been identified as David Gonzalez, 32, from Texas. The homeowner is not facing charges.

When officers arrived, they found Gonzalez already in handcuffs. The person who restrained him was an off-duty police officer who is the boyfriend of the homeowner's daughter. Gonzalez was taken to a hospital, where he was listed in serious condition. He is now in Fresno police custody for felony assault.

Several questions remain open. A neighbor told local reporters that police linked damage on his car to the struggle, saying Gonzalez pushed the daughter into it. Fresno City Councilmember Miguel Arias said Gonzalez drew his own firearm during the fight. Fresno police have not publicly confirmed that detail. Police also have not said why an agent from Texas was in that neighborhood, and they say that part of the case is still under investigation. The description of him as drunk comes from police, based on how he appeared at the scene. No blood alcohol results have been released.

Local leaders reacted quickly. Councilmember Mike Karbassi said, "Nobody deserves to have somebody drunk on their lawn at three in the morning. Especially when you're a senior." Karbassi also called on ICE to suspend its ongoing operations in the Central Valley while the case is reviewed.

The case is likely to raise wider questions. Gonzalez lives in Texas, and it is not yet known whether he was in Fresno for work or for personal reasons. If the charges move forward, the case will go through the Fresno County court system like any other felony assault case. Police have said more details will come as the investigation continues.

For now, the family is safe, the homeowner is not being charged, and the agent is in custody.

Under California law, a person may use force, including deadly force, to defend themselves or others when they reasonably believe they face imminent danger of serious bodily harm. Police have said the homeowner is not facing any charges in the shooting.

Do you back the homeowner? YES OR NO?
